What causes wrongful death?
Wrongful death is caused by negligence, which could take many forms. Car accidents, slip and falls, workplace injuries, dangerous or defective products, and medical malpractice can all be factors of wrongful death — and, of course, that's not an extensive list. How much time do I have to file a wrongful death claim?
In Washington DC, family members can file a claim within two years of their loved one's passing. The statute of limitations also two years in Virginia and is three years in Maryland.
What will the compensation cover?
Typically, families choose to use the damages awarded for things like:
- medical bills
- funeral and burial expenses
- emergency care
- lost wages and benefits the victim would have earned until he or she retired
- contributions for surviving family members, such as spouse and/or children
While there isn't a cap on how much you receive in damages, there is a limit on the type of damages you can file to receive. Grief, pain and suffering, and other types of emotional distress will not be compensated.
